Patient App Terms of Use

These Patient App Terms of Use apply when you use the EMERGE patient application, patient portal, patient-facing web pages or patient features provided by 12677776 Canada Ltd., operating as EMERGE Healthcare Co. (“EMERGE”).
EMERGE is a technology platform
EMERGE provides technology that healthcare providers and clinics use to deliver and manage healthcare services.
EMERGE is not your doctor, healthcare provider or clinic and does not itself establish a healthcare-provider relationship with you merely because you use EMERGE.
Questions about your diagnosis, treatment, prescriptions, medical record or care should be directed to your healthcare provider.
If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency care.
Your account
You must provide accurate information and take reasonable steps to protect your account.
Do not share your password or authentication credentials.
You are responsible for activity occurring through your account unless it results from circumstances outside your reasonable control.
Where permitted, a parent, guardian, substitute decision-maker or other authorized representative may access services on behalf of another person.
Your healthcare provider
Clinics and healthcare providers using EMERGE are independent from EMERGE.
Your healthcare provider is responsible for professional care and, where applicable, is the health information custodian responsible for your medical record.
EMERGE stores and processes information on their behalf when providing the Platform.
Appointments and communications
EMERGE may allow you to:
- book or manage appointments;
- complete intake forms;
- exchange messages;
- participate in virtual visits;
- receive reminders;
- access documents;
- receive prescriptions or requisitions;
- submit information to your provider; and
- use other healthcare-related functionality.
Availability of features depends on your provider.
Appointment confirmation through EMERGE does not guarantee that a provider will be available exactly at the scheduled time.
Artificial intelligence and Evie
EMERGE may provide artificial-intelligence-assisted features, including Evie and other tools that summarize, organize, transcribe or explain information.
AI-generated content can contain mistakes, omissions or inaccurate interpretations.
AI functionality is not a substitute for professional medical advice, diagnosis or treatment.
Do not delay seeking professional care because of information generated by an AI feature.
Before making healthcare decisions based on AI-generated information, review it with an appropriate healthcare professional.
Where an AI feature captures or processes information from a healthcare encounter, additional notice or consent may be presented at the time the feature is used.
Patient information
Information you provide to your healthcare provider through EMERGE may become part of your clinical record.
The applicable healthcare provider or clinic generally determines how that clinical information is collected, used, disclosed, retained and corrected.
Requests concerning a clinical record should normally be directed to the healthcare provider or clinic responsible for it.
EMERGE’s handling of personal information is explained in the EMERGE Privacy Policy and Patient Privacy Notice.
Appropriate use
You may not use EMERGE to:
- impersonate another person;
- access another person’s information without authorization;
- disrupt or interfere with the Platform;
- upload malicious content;
- attempt to bypass security measures; or
- engage in unlawful activity.
Availability
Technology can occasionally become unavailable.
If you cannot access EMERGE and require urgent medical assistance, do not wait for the Platform to become available. Contact your provider through another available channel or seek appropriate urgent or emergency care.
Intellectual property
EMERGE owns or licenses the software, design and technology used to provide the Platform.
These Terms do not transfer ownership of your personal or health information to EMERGE.
Consumer rights
Nothing in these Terms excludes rights you have under applicable consumer-protection, privacy or other laws that cannot legally be waived.
Liability
To the extent permitted by applicable law, EMERGE is not responsible for clinical decisions made by healthcare providers or for healthcare services delivered by independent providers through the Platform.
Nothing in these Terms excludes liability that cannot legally be limited.
Changes
We may update these Terms as the Platform evolves or legal requirements change.
Where a change materially affects your rights, we will provide notice where reasonably appropriate.
